Lets examine why so many people are calling for the legalization of Marijuana.
LEAP, The Law Enforcement Against Prohibition's Official Position:
“We believe that drug prohibition is the true cause of much of the social and personal damage that has historically been attributed to drug use. It is prohibition that makes these drugs so valuable – while giving criminals a monopoly over their supply. Driven by the huge profits from this monopoly, criminal gangs bribe and kill each other, law enforcers, and children. Their trade is unregulated and they are, therefore, beyond our control."
"History has shown that drug prohibition reduces neither use nor abuse. After a rapist is arrested, there are fewer rapes. After a drug dealer is arrested, however, neither the supply nor the demand for drugs is seriously changed. The arrest merely creates a job opening for an endless stream of drug entrepreneurs who will take huge risks for the sake of the enormous profits created by prohibition. Prohibition costs taxpayers tens of billions of dollars every year, yet 40 years and some 40 million arrests later, drugs are cheaper, more potent and far more widely used than at the beginning of this futile crusade."
"We believe that by eliminating prohibition of all drugs for adults and establishing appropriate regulation and standards for distribution and use, law enforcement could focus more on crimes of violence, such as rape, aggravated assault, child abuse and murder, making our communities much safer. We believe that sending parents to prison for non-violent personal drug use destroys families. We believe that in a regulated and controlled environment, drugs will be safer for adult use and less accessible to our children. And we believe that by placing drug abuse in the hands of medical professionals instead of the criminal justice system, we will reduce rates of addiction and overdose deaths."
Marijuana Prohibition Penalizes Otherwise Law Abiding Citizens |
"Criminal marijuana prohibition is a failure. Over 20 million Americans have been arrested for marijuana offenses since 1965. NORML believes that the time has come to amend criminal prohibition and replace it with a system of legalization, taxation, regulation, and education."
"Marijuana prohibition applies to everyone, including the sick and dying. Of all the negative consequences of prohibition, none is as tragic as the denial of medicinal cannabis to the tens of thousands of patients who could benefit from its therapeutic use."
"Marijuana prohibition causes far more problems than it solves, and results in the needless arrest of hundreds of thousands of otherwise law abiding citizens each year."
Aaron Kenneth Schwarz's Official Position
The War on Drugs Causes Incredible Violence in Mexico |
The war on drugs is the cause of most of the crime related to drug use. Because criminal organization are forced to supply the free market with the drugs the free market demands, billions of dollars are funneled into organized criminal groups when narcotics are illegal. The violent problems on the US Mexico border for example could all be ended instantly if heroin, cocaine, marijuana, mdma and other drugs were reclassified as prescription, and made available to those who are addicted to them at a pharmacy with a prescription for a price they can afford without resorting to crime to pay for their habits.
Love: We should spend the money on helping Addicts not War: |
The war on drugs is one of the most expensive public policy failures since alcohol prohibition. Every single year the direct costs of this war range in the tens of billions just in the US. Hundreds of billions in world wide public funding is misdirected into this hateful misguided war against freedom.
Destroying our Freedom: The Government Axes Away at our Rights |
The war on drugs operatives through a flagrant series of constitutional violations that emit the stench of a philosophical dictatorship. The war on drugs reminds me of book burning and the narrative 1984. We do not live in a democracy if the Gov is waging a war against its people like it does with the war on drugs. Criminalizing innocent drug users who commit no other crimes, and push ordinary people who have a substance abuse problem into interacting with criminals to get their substances. The prohibitions laws are the problem with drugs, not the solution.
A loving person reaches out to help a heroin addict. |
Drug addicts need help, not legal and criminal condemnation. The reason people use drugs usually stems from unresolved emotional, social, spiritual and psychological problems. These people need professional medical and psychiatric help, not a criminal rap sheet and time in jail or prison. As for the criminal entrepreneurs that distribute drugs, they are only functioning as an element of the free market. No amount of government intervention will ever keep the free market from functioning. If there is a demand for something, someone will always be willing to supply it, regardless of the law
Overdose Death from the Inconsistent Quality of Street Drugs |
The war on drugs is more harmful to every person and society as a whole than any substance ever has or ever will be for the reasons stated above. We need to focus on education, health care, treatment and help for these drug addicts. The last thing on earth a drug addict needs is criminal condemnation. The reasons they are using drugs in the first place is because they need help.
Where is the Reasonable Thinking?
Where is the logic in the war on drugs? We already clearly saw that prohibition was a miserable failure with the draconian alcohol laws of the early twentieth century! Do we really need to keep reliving this failure over and over and over when the government is 14 + trillion in debt? Can we really afford to keep doing the wrong thing over and over and over again?
The federal statute placing marijuana as a Schedule I substance is inconsistent with the scientific findings that marijuana and its active constituents are effective at treating hundreds of medical conditions; findings that are supported by 16 states who's medical marijuana laws confirm the science. http://www.mpp.org/library/policy-analysis-alternatives.html
A medical marijuana dispensary in California. |
Millions of arthritis, glaucoma, cancer, pain, HIV, Chrones patients: millions of people who suffer from a wide range of medical/ psychological ailments can benefit from the use of cannabis products in a ways that they are not helped by conventional narcotics and synthetic pharmaceuticals. The cannabinoids in the cannabis plant are useful in the treatment and prophylaxis of wide variety of oxidation associated diseases, such as ischemic, age-related, inflammatory and autoimmune diseases. The cannabinoids in marijuana are found to have particular application as neuroprotectants, for example in limiting neurological damage following ischemic insults, such as stroke and trauma, or in the treatment ofneurodegenerative diseases, such as Alzheimer's disease, Parkinson's disease, and Dementia.

The History: A brief example...
The federal statute is the result of Richard Nixon's racial bigotry and hatred for hispanic minorities. The continued incoherent federal statutes are a historical leftover of Tricky Dick's long lost era of lies and manipulation. He was a sleazy dishonest crook, and the DEA that enforces his sleazy laws are wasting time, tax money, police and state resources, jail and prison space, and violating basic human rights in the process.

Focus On Real Crimes
The State should focus their resources on catching criminals who violate other peoples rights; rapists, murderers, pedophiles, identity thieves, financial fraud and other forms of anti-freedom/ hate and violence that hurts our country and society; focus on real criminals. By wasting time dealing with victimeless marijuana law violations they are distracted from working on their real Job duty, protecting the public from criminals. http://en.wikipedia.org/wiki/Crime
The Reasons People Use
People who use marijuana recreationally for the same reason that people use tobacco and alcohol; for the relief of stress, anxiety and pain. Millions of people use tobacco, alcohol and caffeine products; chocolate, sugar and pastries for exactly the same reason. Marijuana is more natural, more effective and much safer than these other psycho-actives that are so widely used and socially acceptable.
http://en.wikipedia.org/wiki/Effects_of_cannabis
http://en.wikipedia.org/wiki/Cannabis#Industrial_and_personal_uses
Modes of Use
Marijuana can be cooked into foods, vaporized, smoked or extracted and or consumed as a liquid; the versatility of active delivery methods means flexible options for medical treatment and recreation use alike. http://en.wikipedia.org/wiki/Cannabis_(drug)#Routes_of_administration
Different Kinds for Different Applications
There are thousands of strain types, each with a unique medicinal, flavor, color and quality profile; different kinds have different medicinal and social applications based on their strength and flavor; similar to how there are many kinds of beer, wine and mixed drinks for different settings and different applications. http://en.wikipedia.org/wiki/Cannabis_(drug)#Forms
Lost Source of Tax Revenue
We could have legal marijuana generating billions of tax revenue for the states and federal government; where labels would clearly indicate the strength, potency and strain type, and recommended use; but under the current federal statute, billions of dollars are diverted away from the government and into the grey and black market where organized criminals are forced to supply the innocent customers who prefer this plant flower over the legal alternatives like tobacco and alcohol. http://docs.mpp.org/pdfs/library/T-R_Effective-Arg-0110.pdf
Marijuana Prohibition Does not Make Sense
I cannot understand nor will I ever endorse or support any law against marijuana except those that govern its access to adults; the same way that we have common sense laws restricting alcohol and tobacco products to adults. I also do not advocate violation of the federal statute as doing so is dangerous because of the legal risks of arrest, prosecution and incarceration.
Help The Sick
The fact that there is a federal law restricting patients from access to their preferred highly effective and safe medicine is an absurdity. Please join me and millions of others in saying no to prohibition and yes to freedom for marijuana: vote yes for legalization.
Legal Disclaimer: For Clarity
I Aaron Kenneth Schwarz do not use marijuana or any derivatives of the cannabis plant and I furthermore do not condone or endorse the violation of any laws. Those who do have a legitimate medicinal reason for using marijuana as a medicine may contact the green cross of washington state to establish contact with doctor.
Comparing the Holy Writ of 350AD to Prohibition Ethics
Adapted from Ch. 25 Galileo “Tihkal” by Alexander & Ann Shulgin
Then
The earth is the center of the universe, and anyone who says otherwise is a heretic and shall be imprisoned.
Now
All drugs that can expand consciousness are without medical or social justification, and anyone who uses them is a criminal and shall be imprisoned.
|| Young Galileo sitting in front of the Cardinals of the Inquisition:
“Are you engaging in heretical teachings along the lines of Copernicus, in contradiction to the facts known and taught by the Catholic church?” ; sitting there knowing he had made a promise that he would not act in violation of the faith…
The authorities continue…
Then:
“We do not need to actually look through that mysterious contraption (telescope) of yours to see what is fact and what is fiction.“
Now:
“There is no need for anyone to actually taste those mysterious mind altering compounds of yours to see what is fact and what is fiction.
Then Authorities continue…
“We know what is real and we know what is not real. It is written in all of the texts and no recourse to such artificial means is needed. To entertain such notions is contrary to nature and is to manifest the work of the devil.
Then:
“How dare you claim that the earth is not the center of the universe? Your looking glass, your moons around Jupiter, and your navigation tables prove nothing. Your heresy is an affront to the church, and to God who made the earth the center of the universe and gave us the Sun as our clock.”
It has been almost four centuries…
Now:
“How dare you claim that an understanding of God is to be found in a substance? This talk of communication with the inner self, the finding of ones’s way into the hidden reaches of the unconsciousness, is new age nonsense and simply an excuse to use dangerous drugs.
It has been many decades…
The authorities continue…
“Since the original pronouncement had been made that the reality as seen through these evil instruments had no merit. The authority as invested in the church (then) has admitted that is had been wrong. The authority as invested in the government (now) has not yet made this statement; in time it will.
The Chemistry Continues:
My long standing views about legalizing marijuana are born out of my passionate interest in Freedom of choice. I believe my body is my own space, and what I choose to do with my body is my own God given right!
The Following is Adapted from Ch 24. Cui Bono.
It is time that we call for a drug war truce with Peace Negotiations
Preamble; No civilized nation makes war on its own citizens. We the people, did not declare war on our government no do we wish to fight this unethical drug war you wage against of constitutionally granted personal freedoms. Hence, we not petition for redress of grievances, as follows.
Whereas any just government derives its authority from a respect of the People’s rights and powers: and
Whereas the government has resorted to unilateral military force in the Drug war without any good faith effort to negotiate a peace settlement:
Therefore, we hereby call for a Drug War Truce during which to engage our communities and governments in peace negotiations, under the following terms”
Article 1: The United States shall withdraw from, repudiate, or amend and all international Treaties or agreements limiting its ability to alter domestic drug policy.
Article 2: No patient shall be prosecuted nor any health care professional penalized for possession or use of any mutually agreed upon medications.
Article 3: Drug policy shall henceforth protect all fundamental human rights, as described below:
1. Each person retains all of his inalienable Constitutional, and Human Rights, without exception. No drug regulation shall violate these rights.
2. The benefit of the doubt shall always be given to the accused and to any property or asset at risk. Courts shall allow the accused to present directly to the jury any defense based on these Rights, and explanation of motive or any mitigation circumstances, such as religion, culture, or necessity.
3. No victim; no crime! The burden of proof and corroboration in all proceedings shall lie with the government. No secret witness nor paid testimony shall be permitted in court, including that of any government agent or informant who stands to materially gain through the disposition of a drug case or forfeited property. No civil asset forfeiture shall be levied against a family home or legitimate means of commercial livelihood.
4. Issues of entrapment, government motive, and official misconduct shall all be heard by the jury in any drug case civil or criminal. Government agents who violate the law are fully accountable and shall be prosecuted accordingly.
5. Mandatory minimum sentences undermine our system of justices. The jury shall be informed of all penalties attached to any offense before deliberating a verdict. Courts shall have the discretion to reduce penalties in the interest of justice.
Article 4: We the people propose a Drug War Truce and call for the immediate release of all non-violent and aside from drug charges involving adults only, law abiding citizens.
Article 5: No non-violent drug charges involving adults only shall be enforced or prosecuted until all parties have agreed to, and implemented, a drug policy based on full respect for the accused parties fundamental rights and personal responsibilities.
Of course the above is only simply making a restatement of the rights that have been our heritage from the Magna Carta, British common law, and our own constitution.
In this truce there is an tremendous amount to gain, and nothing to loose.
